(1) These Terms of Service (hereinafter the "Terms") govern the contractual relationship between Marvin Rüßbüldt, c/o IP-Management #8928, Ludwig-Erhard-Straße 18, 20459 Hamburg, Germany (hereinafter the "Operator"), and the users of the platform made available at the domain goru.rocks (hereinafter the "Platform").
(2) Deviating or supplementary terms of the user shall not become part of the contract unless the Operator expressly consents thereto in text form.
(3) The currently applicable version of these Terms is made available at goru.rocks/terms.
(1) The Platform is a web-based tool for creating animated videos in two formats: the Chat format (animated group chat) and the Quiz format (multiple-choice questions with characters).
(2) The user provides a topic. An artificial intelligence service generates a script on this basis. The Platform renders a video from the script, which the user may download.
(3) The feature set depends on the selected usage plan (Section 5). The number of videos created per day is not limited; only the number of AI text generations is limited (Section 7).
(4) In addition, the Platform provides registered users with a real-time chat feature (hereinafter the "Live Chat"). Details regarding the Live Chat are governed by Sections 12 to 14.
(5) In connection with the Live Chat, the Platform provides further functions, in particular a voting system ("The World Votes"), the assignment of registered users to a country with associated Power ranking (Country System), and gamification functions (daily chat streak, daily tasks). The processing of the data arising from these functions is governed by the Privacy Policy.
(1) The basic functions of the Platform are available without registration. Without a user account, the user may generate up to 12 chat messages or up to 3 quiz questions per video, at a resolution of 720p, a video length of up to 20 seconds, with a large watermark, and up to 3 AI generations per day.
(2) With a free Free account, the user may generate up to 15 chat messages or up to 4 quiz questions per video, at a resolution of 720p, a video length of up to 20 seconds, with a large watermark, and up to 5 AI generations per day. The Free account additionally allows the saving of scripts.
(3) Registration is carried out via Google OAuth or Discord OAuth. Script drafts may be stored in the local storage of the browser (localStorage).
(1) Use of the Platform requires a minimum age of 13 years.
(2) Users under the age of 16 may use the Platform only with the consent of a parent or legal guardian.
(3) Upon registration, the user confirms the following statement: "I confirm that I am at least 13 years old. If I am under 16, I have parental or guardian consent."
(4) No active age verification is carried out.
(1) The Platform is made available in the following usage plans:
(a) Free (free of charge): up to 15 chat messages or 4 quiz questions per video, video length up to 20 seconds, 720p resolution at 24 frames per second, large watermark;
(b) Starter (€4.99 per month): up to 25 chat messages or 6 quiz questions per video, video length up to 45 seconds, 1080p resolution at 30 frames per second, small watermark;
(c) Pro (€14.99 per month): up to 50 chat messages or 12 quiz questions per video, video length up to 90 seconds, 1080p resolution at 30 frames per second, small watermark;
(d) Business (€49 per month): up to 100 chat messages or 20 quiz questions per video, video length up to 120 seconds, 1080p resolution at 30 frames per second, small watermark.
(2) Paid subscriptions are billed monthly and renew automatically for successive one-month periods until terminated by the user (Section 9).
(3) All prices are stated in euros and inclusive of all applicable taxes. The Operator applies the small-business regulation pursuant to Section 19 of the German VAT Act (UStG); no VAT is charged.
(4) The Live Chat is available to all registered users. Joining public rooms is possible in all plans. Creating own rooms and certain further functions are limited depending on the plan:
(a) Free: one concurrent own room, up to 10 participants per room, no private rooms, no custom group name;
(b) Starter: three concurrent own rooms, up to 15 participants per room, no private rooms, custom group name available;
(c) Pro: five concurrent own rooms, up to 30 participants per room, private rooms available, custom group name available;
(d) Business: ten concurrent own rooms, up to 30 participants per room, private rooms available, custom group name available.
The creation and download of highlight and session videos from the Live Chat is subject to the credit rules under Section 6(3) accordingly.
(5) The Operator reserves the right to modify features and pricing. Section 22 remains unaffected.
(1) Credits are a digital unit of account acquired by way of one-time purchase. Acquired credits do not expire.
(2) The following credit packages are offered:
(a) 10 credits for €0.99;
(b) 30 credits for €2.49;
(c) 60 credits for €4.99;
(d) 150 credits for €9.99;
(e) 350 credits for €19.99.
(3) Credits may be redeemed in particular for the following functions:
(a) additional chat messages: 10 messages (3 credits), 20 messages (5 credits), 30 messages (8 credits);
(b) additional quiz questions: 3 questions (3 credits), 5 questions (5 credits), 10 questions (8 credits);
(c) upgrade to 1080p (5 credits);
(d) one additional AI generation once the daily limit has been reached (1 credit);
(e) removing the watermark for a single video (15 credits).
(4) Functions already included in the selected plan do not require the use of credits.
(5) Credits have no cash value. They are not redeemable for cash and not transferable to other users.
(6) Upon deletion of the user account, unspent credits expire without any claim to a refund.
(1) The number of videos created per day is not limited. Only the number of AI text generations per day is limited:
(a) without a user account: 3 generations;
(b) Free: 5 generations;
(c) Starter: 15 generations;
(d) Pro: 30 generations;
(e) Business: 50 generations.
(2) Once the daily limit has been reached, each additional AI generation may be requested against the use of one credit.
(3) Use of the manual editor is not subject to any quantitative limit.
(1) Payments are processed via the payment service provider Stripe. The Operator does not store any credit card data.
(2) Payment methods include, subject to the user's country and the rules of Stripe, in particular credit and debit card, Google Pay, Apple Pay, PayPal, SEPA direct debit, Klarna, iDEAL, Revolut Pay, Bancontact, BLIK, EPS, and Pix.
(3) Before completing a paid transaction, the user accepts these Terms by activating the corresponding control.
(4) Upon conclusion of a subscription, the following notice is displayed: "This subscription renews automatically every month. You can cancel anytime."
(5) For the purpose of evidencing the contractual terms, the Operator logs, for each paid transaction, the timestamp, the version of the Terms, the IP address, the payment method, the product purchased, and confirmation of the relevant controls.
(1) Subscriptions may be cancelled at any time via the account settings or via the Stripe Customer Portal.
(2) Cancellation takes effect at the end of the current billing period. No refund is granted for the partial billing period.
(3) Upon the cancellation taking effect, the user account reverts to the Free plan. Credits already acquired are retained.
(4) If the user deletes their user account in full (Section 14 of the Privacy Policy), any existing subscription is automatically cancelled. The billing period already paid is not refunded. Unspent credits expire pursuant to Section 6(6) without substitute and without any claim to a refund.
(1) Consumers have a statutory right of withdrawal. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession.
(2) The withdrawal period is 14 days from conclusion of the contract. To exercise the right of withdrawal, an unambiguous statement to the Operator, for example by email to info@goru.rocks, is sufficient.
(3) In the case of digital content, the right of withdrawal lapses where the Operator has begun performance of the contract after the user has expressly consented to the Operator beginning performance before the expiry of the withdrawal period and has confirmed their awareness that, by giving such consent, they lose their right of withdrawal.
(4) Before completing a paid transaction, the user confirms the following statement: "I agree to the Terms of Service and acknowledge that my right of withdrawal expires upon delivery of digital content."
(5) Where a withdrawal is validly exercised, the Operator shall reimburse payments already made without undue delay.
(1) All videos created via the Platform — including videos generated from the Live Chat (Section 13) — bear the marking "made with goru.rocks" as a watermark.
(2) The size and position of the watermark depend on the selected plan. In the plans without registration and Free, the watermark is displayed large; in the Starter, Pro, and Business plans, it is displayed small.
(3) The watermark is burned into the video file on the server side. The unauthorised removal, covering, cropping, overlaying, or other obscuring of the watermark is prohibited.
(4) Users may remove the watermark from a single video by redeeming 15 credits pursuant to Section 6(3)(e). Watermark removal applies to that individual video only and does not carry over to subsequent videos.
(5) A breach of paragraph 3 entitles the Operator to suspend the user account immediately and without refund.
(1) In the Live Chat, registered users may create public or private rooms or join existing rooms. In addition, the Operator permanently maintains four standard rooms.
(2) Use of the Live Chat requires a registered user account. Use without registration is not possible.
(3) Before participating in the Live Chat for the first time, the user must set a display name (hereinafter the "Username"). The Username applies at account level and is displayed beneath the user's chosen character on each message.
(4) Usernames that are classified as inappropriate following automated review may be blocked or adjusted by the Operator. The user may change their Username at most once within any 30-day period.
(5) Within a room, each participant selects a character (currently exclusively countries with their flags). Each character may be assigned only once per room.
(6) Messages are transmitted in real time. Messages are not end-to-end encrypted; all messages are stored on the server side and are encrypted at rest using AES-256 encryption. Server-side storage and the ability to decrypt messages are prerequisites for moderation (Section 14) and for the generation of videos from the Live Chat (Section 13).
(7) The creator of a room is its host. The host is entitled to remove or mute participants, delete individual messages, change the room topic, and close the room. If the host leaves the room, the host role is automatically assigned to another participant; it may also expressly be transferred to another participant.
(8) Private rooms are accessible solely via an invite code and are not listed in the public room directory. There is no end-to-end encryption in private rooms either.
(1) The Platform automatically generates short invite videos with a duration of approximately 5 to 8 seconds for each public room (hereinafter "Invite Videos"). Invite Videos depict the characters currently present in the room as well as generic messages produced by the system. Actual chat messages of users are not part of Invite Videos.
(2) On request, highlight videos and a full recording of a chat session (hereinafter "Session Rendering") may be generated from the course of a chat session. Highlight videos and session videos contain the actual messages of the participants.
(3) All videos generated from the Live Chat bear the watermark "made with goru.rocks". Section 11 applies accordingly.
(4) By joining a public room, the user consents to the right of every participant to generate, download, and publish highlight and session videos on third-party platforms, in particular TikTok, Instagram, YouTube, and WhatsApp. Before joining a public room, the user is informed of this legal consequence in a separate consent dialog (Join-Consent).
(5) Users who wish to exclude the publication of their messages to third parties must use a private room. In private rooms, highlight and session videos may be generated only by participants of the room; publication beyond the circle of participants is prohibited.
(1) The moderation of user-generated content — in particular chat messages, vote comments, and voting questions created by users — is carried out by a three-layered, largely automated system:
(a) pre-filter (pre-send blocking): keyword- and regex-based filters prevent obviously inadmissible content from being sent at all;
(b) AI scoring: each message is asynchronously evaluated by an artificial intelligence service (OpenAI) for indications of harassment, hate speech, threats, or spam;
(c) context AI: incoming Reports are transmitted, together with the immediately preceding message context, for AI-assisted evaluation.
(2) Standard of moderation: prohibited are in particular personal attacks, harassment, hate speech, threats, spam, and identity fraud. The use of uppercase letters (caps) is not in itself a ground for suspension. Generalised, jocular statements about countries in the sense of the game mechanics (country banter, e.g. "your country sucks") are permitted in the Live Chat; personal attacks against the individual user (e.g. "you are ugly") are not.
(3) Each message provides a reporting function with selection of a reason for reporting (hereinafter "Report"). The evaluation of a Report is carried out automatically by the moderation system.
(4) If the moderation system confirms a rule violation — whether by its own assessment or via a meritorious Report — this event is recorded as a "Violation". A Violation may immediately trigger automated measures, in particular warnings, the removal of individual messages, temporary mutes, or further restrictions on the user account.
(5) If a user receives three meritorious Reports within a session, they are automatically muted (Mute) for the duration of that session.
(6) If five confirmed Violations are recorded against a user, the user account is automatically and permanently suspended. The further consequences of permanent suspension — in particular the deletion of messages, the release of the Username, and the imposition of an IP restriction on all hashed IP addresses associated with the user — are governed by Section 18.
(7) Notwithstanding the strike system set out in paragraph 6, the Operator reserves the right to impose an immediate and permanent ban without prior warning in cases of particularly severe violations. These include in particular:
(a) sexual content of any kind, including through evasion techniques such as wordplay, emoji substitution, or character replacement;
(b) content that sexualises, grooms, or endangers minors;
(c) racial slurs or hate speech;
(d) credible threats of violence;
(e) doxxing or the sharing of personal information of other users;
(f) the repeated creation of new accounts to circumvent a previous ban.
In such cases, the ban takes effect immediately and encompasses the user account, all associated hashed IP addresses, and the device fingerprint. All messages of the banned user are permanently deleted.
(8) The measures under paragraphs 4 to 6 are based on automated processing within the meaning of Art. 22 GDPR. The user has the right to request human review of any measure imposed against them. Requests shall be sent to info@goru.rocks; Section 13 of the Privacy Policy applies accordingly.
(9) Misuse of the reporting function, in particular the repeated submission of unmeritorious Reports, may itself give rise to the recording of a Violation and to measures under paragraph 4.
(1) Voting system ("The World Votes"). All users may participate in votes; only one vote per question and user is permitted. Duplicate voting by users who are not logged in is prevented by means of a hashed IP address. Vote results are available with extended display and render options upon reaching 10, 25, and 100 votes respectively. Comments on a vote may be submitted exclusively by logged-in users who have already cast a vote on the respective question.
(2) User-created voting questions. Registered users may create their own voting questions (User Generated Content).
(a) The user retains the copyright in their questions.
(b) By creating a question, the user grants the Operator a free, worldwide, unlimited in time, and non-exclusive licence to display, distribute, and reproduce the question within the scope of the service, including all associated functions (in particular Vote Result Videos under paragraph 5).
(c) The user is solely responsible for ensuring that their questions do not infringe any third-party rights, in particular copyright, trademark, naming, or personality rights.
(d) The Operator is entitled to remove questions without prior notice insofar as they violate these Terms or infringe third-party rights.
(e) Each question is subject to automated content review pursuant to Section 14 prior to publication.
(3) Country System. Upon first participation in the Live Chat, the user selects a country; this selection is final in the current version of the service and cannot be changed by the user. The Power points earned for a country result exclusively from actual user activity; Power points cannot be acquired through payments or credits. There is no pay-to-win mechanism.
(4) Streak and Daily Tasks. The Platform provides gamification functions, in particular the display of a consecutive chat streak and daily tasks. The user has no claim to particular rewards, special privileges, or financial compensation arising from these functions. To the extent the Operator provides rewards, this is done on a voluntary basis.
(5) Vote Result Videos. Upon reaching the thresholds set out in paragraph 1, a video may be rendered from the result of a vote. The video bears the watermark "made with goru.rocks"; Section 11 applies accordingly. The publication of the rendered video by the user on third-party platforms is governed by Section 13(4) accordingly. In all other respects, Vote Result Videos are subject to the same conditions as videos created via the Video Creator; Section 19(2) (retention period of 24 hours) applies accordingly.
(6) Intellectual property in aggregated voting data.
(a) All aggregated voting results, statistics, country breakdowns, and data visualisations displayed on the Platform are the intellectual property of the Operator.
(b) Commercial reproduction, redistribution, or use of voting results for commercial purposes — in particular in advertisements, commercial research reports, paid publications, or commercial products — requires the prior written permission of the Operator.
(c) Personal, non-commercial sharing of individual voting results, including screenshots and social media posts, is expressly permitted.
(d) The Operator is entitled to use anonymised and aggregated voting data for its own commercial purposes, including the licensing of such data to third parties for market research, statistical analysis, and related purposes.
(1) Script generation is performed using artificial intelligence services provided by OpenAI.
(2) AI-generated content may be inaccurate, inappropriate, or offensive. Prior to download, the following notice is displayed: "Content generated by AI may be inaccurate, inappropriate, or offensive. Use at your own discretion."
(3) The user is solely responsible for all content they create, download, or distribute via the Platform, including AI-generated content. The user is obliged to review all generated content prior to distribution and to ensure that no third-party rights, in particular trademark and copyright rights, are infringed.
(4) AI-generated content is produced in the language of the user's input. The Operator gives no warranty as to linguistic accuracy or cultural appropriateness.
(5) The Operator is not liable for claims arising from the publication of AI-generated content by the user.
(1) The creation or distribution of content that
(a) contains hate speech, discrimination, racism, or antisemitism;
(b) is sexually explicit or pornographic;
(c) glorifies or trivialises violence;
(d) violates applicable law or infringes third-party rights;
(e) is liable to endanger minors
is prohibited.
(2) The following actions are also prohibited:
(a) identity theft, defamation, and fraud;
(b) reverse engineering, scraping of content, and the use of automated procedures (bots);
(c) the resale of user accounts or credits;
(d) the circumvention of usage limits or payment mechanisms;
(e) in the Live Chat: appearing under a false identity (impersonation), the mass or repeated sending of similar messages (spam), the deliberate disruption of roleplay sessions, and the misuse of the reporting function (Section 14(9)).
(1) In the event of a breach of these Terms, the Operator is entitled to mute the relevant user account, to suspend it for individual functions — in particular the Live Chat —, to suspend it in full, or to delete it. The choice of measure is governed by the nature and severity of the breach.
(2) In the event of a full suspension due to a breach, acquired credits expire, any existing subscription is cancelled, and no refund of payments made is granted.
(3) If five confirmed Violations within the meaning of Section 14(4) are recorded against a user, the user account is permanently suspended, notwithstanding the measures under paragraph 1.
(4) Upon full suspension, all messages posted by the user in the Live Chat and all vote comments are deleted. The user's Username is released for re-use by other users. Anonymised statistical data, in particular the contributions to the Country ranking, are retained in aggregated form.
(5) To prevent the circumvention of suspension measures, in the case of a permanent suspension the Operator imposes an IP restriction that automatically extends to all hashed IP addresses associated with the user in the preceding activity logs. The Operator may also impose a restriction based on the hashed IP address independently of an account suspension in the case of severe or repeated rule violations. Reversal of the hash to the original IP address is not possible. IP-based restrictions may be applied indefinitely.
(1) The Platform is provided in its respective available form. The Operator gives no warranty as to uninterrupted availability or freedom from errors.
(2) The Operator is liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
(3) In the case of slight negligence, the Operator is liable only for the breach of essential contractual obligations (cardinal obligations) and, in that case, limited to the foreseeable damage typical for this type of contract.
(4) The Operator is not liable for user-generated or AI-generated content.
(1) The Operator endeavours to maintain a high level of availability of the Platform. There is no claim to uninterrupted availability.
(2) Rendered video files are deleted 24 hours after creation. The user is advised to download created videos within this period.
(3) The following additional retention and deletion periods apply to messages in the Live Chat:
(a) messages in public rooms are stored permanently until deletion of the user account;
(b) messages in private rooms are stored permanently until deletion of the user account;
(c) messages that have been the subject of a Report are retained for 90 days for the purpose of evidence and are deleted thereafter.
(1) The Operator maintains a Creator Program. Participation requires an application by email and approval by the Operator; there is no automated admission procedure.
(2) Creator status is not a usage plan. Approved Creators receive the Pro plan free of charge.
(3) Approved Creators receive a recurring commission of 15% to 25% on all payments by the customers they refer. Registered users without Creator status receive no commission.
(4) Payout of a commission in money requires that the Creator has reached the age of 18. Creators under the age of 18 participate in the Creator Program, receive the Pro plan free of charge, and are displayed on the Creator Wall; in lieu of a cash payout, the corresponding commission is credited to them in the form of credits.
(5) Payouts are made monthly from a minimum balance of €50. The tax treatment of commission income lies with the Creator.
(6) Further functional details of the Creator Program will be governed at a later date.
(1) The Operator may amend these Terms with effect for the future. Registered users will be notified of amendments by email at least 30 days prior to their entry into force.
(2) There is no permanent vested protection for existing conditions.
(3) Continued use of the Platform after the effective date constitutes acceptance of the amended Terms. If the user does not consent to the amendments, they may cancel the user account and any existing subscriptions before the effective date.
(1) The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction for disputes with merchants is Hamburg. Consumers retain the mandatory protection rules of their country of residence.
(3) Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
(4) The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. The Operator is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration body.
